If you are a beneficiary of a Palm Beach estate, or if you expect to get an inheritance, you may be asking your Estate Lawyer Palm Beach: where’s my money?
Can Estate Beneficiaries Demand Inheritances from Florida Executors?
- You have rights as an estate beneficiary , don’t you ?
- Or course you do ! The Florida Probate Code provides rights for family members , heirs and other beneficiaries of Palm Beach Probates
- But….. you don’t get to run the estate…. the Executor of the Will runs the estate
- In Florida, we call an executor of an estate the Personal Representative
Florida Probate Code Law on Inheritances
- Check out Florida Probate Code 733.801
- This Florida probate law says that no personal representative shall be required to pay or deliver any inheritance to an estate beneficiary until 5 months have elapsed
- 5 months from when? (read the probate law)
- The point is this: probate beneficiaries should monitor the estate and receive information from the executor of the Palm Beach probate
- But beneficiaries can’t demand your inheritance within 5 months
- In fact, if it’s a large estate with probate litigation issues, like a Will Contest Palm Beach, or an estate tax return to be filed, don’t expect your full inheritance until those matters are resolved
- Although….there is a way to try to get your inheritance sooner
- Do you know how?
