Many times when handling a contested dispute in a probate or estate, a petition for the appointment of a curator is filed. What is a curator? What do curators do? How are they different than a Florida personal representative or executor? How are they different than guardians ad litem or administrators ad litem? Florida has a very specific rule on curators. This rule is Florida Probate Rule 5.122. A curator is typically appointed by a judge on a motion or petition to handle the administration of an estate or a very specific role in an estate for a limited amount of time. You should understand how much the curator’s going to be paid and who is going to pay them. You may even have your probate litigation attorney ask the judge to limit the curator’s fee.
