  • This was a lengthy opinion from the Superior Court of Connecticut regarding a probate attorney’s alleged malpractice.
  • The plaintiff was a personal representative of the estate who was very upset about how probate had progressed.
  • Needless to say she blamed the probate lawyer who drew up the estate plan.
  • The estate plan was supposed to be simple, she (plaintiff) was supposed to get it all!
  • Now what happened?
  • Apparently errors in the drafting had led to substantial challenges and will contests by the family members of the decedent.
  • Now the estate and the personal representative had to defend against those issues,and probate litigation is not cheap.
  • Should the probate attorney who drafted the estate plan have to pay those damages?
