I have said multiple times there are a lot of different fee arrangements you  can enter into with a West Palm Beachprobate attorney.  A recent case out of the Fourth District Court of Appeal shows why no matter how you are paying, your attorney should be keeping a timesheet. The question is – are they?

Flat Fee Arrangements

  • There are a lot of ways to arrange payment with your West Palm Beach probate attorney.
  • One such arrangement that many lawyers are agreeing to is a flat monthly litigation fee.
  • Essentially the firm may agree to defend you in a lawsuit for a flat fee per month along with expenses.
  • Many times this is also with the understanding that the excess hours will be paid if attorney’s fee provisions are available.
  • In other words the attorney is willing to provide legal services to you at that flat rate but they reserve the right to go after the other party for fees if allowed by law.
  • Most West Palm Beach Defendants do not mind if their attorney seeks fees from the guy who is suing them.
  • Would you?
  • You may want to make sure they still keep their hourly papers on that though if you want to get attorney’s fees for all the time spent.

Mia Real Estate Holdings, LLC v. Nolan

  • In this case the real estate company sued the defendant and he had to retain an attorney at his own expense.
  • To be specific he entered into an agreement to pay the firm $400/month and they reserved their right to seek fees from the plaintiff if allowed under law.
  • In the end the case wound up so that the defense firm did have a right under the law to attorney fees.
  • The problem was since they had a flat fee agreement they never took the time to actually go ahead and keep their time.
  • In the end they were only able to get back the money the defendant had paid them so he got a full refund but they were not able to get any more money, i.e. from their hourly work.
