post about Trusts, Guardianships, and Alzheimer’s Disease

Guardianship lawyers and trust attorneys in Florida encounter many people who have, unfortunately, developed Alzheimer’s disease and/or dementia. Alzheimer’s disease can prevent a person from being able to properly care for themselves. Therefore, sometimes, a guardianship is needed. Guardianship and estate planning lawyers know that there are ways to avoid a guardianship. There are also ways to insure that the people you wish to inherit from your estate will actually inherit. Contacting an estate planning attorney to draft healthcare documents and/or a trust before you, potentially, become incapacitated can be crucial, especially if you are the owner of an NFL team like Pat Bowlens.

Before Pat Bowlens developed Alzheimer’s disease, he had set up a trust to insure that the ownership of the Denver Broncos would remain in his family if anything were to happen to him. There are three trustees of that trust, and a recent article in The New York Times reveals that a substantial battle between the trustees and some of Bowlen’s family members has begun.

Bowlen’s daughter, Beth Bowlen Wallace, believes that she she should now become controlling owner of the Denver Broncos. The trustees disagree. If her father created the trust so that one of his seven kids could eventually run the team, should the trustees be more open to allowing his daughter take over? Are these trustees doing what is best for the team and for the Bowlen family? To read the entire article, click here.
