Do you plan on disinheriting a child in a West Palm Beach estate plan? Do you know what happens in a will contest and is your will prepared to stand up? You may want to see what the Tennessee Court of Appeals in Knoxville had to say in a recent case.
Will Contests
- After you die your last will and testament will be submitted to the West Palm Beachprobate court.
- In Florida you can dispose of your property pretty much however you want, with some exceptions for public policy reasons.
- Can you think of any?
- So can you disinherit your children?
- Absolutely in fact the only state where you can’t is Louisiana.
- But do you think that one child is going to take it when you disinherit them and leave their share to sisters and brothers?
- Palm Beach probate litigators know that disinheriting a child can lead to an inheritance dispute that could eat up the entire estate.
Watson v. Pike
- An order was granted that issued a new trial in a will contest proceeding.
- The Decedent executed a will in 2010 leaving different portions of his estate to his three children. The man later disinherited one child leaving them mere repayment for a loan that was not formalized. Yet again before dying he rescinded even that. Needless to say a will contest broke out regarding whether or not the later amendments to the will (called codicils) were valid.
- Palm Beach probate litigators know that often disinheriting a child can have large consequences; removed beneficiaries can bite back at the cost of your other children.
- Is your estate plan prepared to stand up to a Palm Beach will contest?
- Is your Palm Beach probate lawyer?
