post about Sterling Family Fights Over Trust and Sale of Trust Asset: LA Clippers

LA Clippers owner Donald Sterling was in court testifying about his Family Trust and the sale of the LA Clippers, evidently by his wife, Ms. Sterling, who is the Family Trust Trustee.

According to published reports:  “Ms. Sterling says she has the right to sell the team without her husband because he is no longer mentally capable of acting as a trustee. Mr. Sterling denied that in Los Angeles Superior Court Tuesday, insisting that doctors at the Cleveland Clinic told him he was “razor sharp.” “

In Florida, there are often guardianship lawsuits and Florida business lawsuits about whether a partner or trustee is incompetent or incapacitated:  and whether someone should, or should not, serve as trustee, or run a company.

  • These probate lawsuits involving incapacity often involve medical evidence and testimony : lots of it.
