post about Robin William’s Estate is back in Court- What is wrong now?

Sometimes an inheritance can be expensive, too expensive  in fact. Do you know why? Often times that luxurious beach house in Boca that you just inherited comes with some expensivemaintenance bills not to mention a mortgage and taxes! What happens when you cannot afford the house anymore, do you have a right to ask the estate for help? Check out what is going on as Robin William’s estate is back in Court as his former wife files a complaint saying she cannot afford to live in her beach house anymore.

Inheriting the Beach House

  • In the old days when you inherited property with a mortgage attached you had a right to ask that the estate pay for the property’s mortgage.
  • This allowed you to take it free and clear the West Palm Beach liens that encumbered the property.
  • These days though without explicit instructions in the will you do not have that right anymore.
  • You cannot demand that the personal representative give you the property free and clear.
  • So what happens when you cannot afford to pay the taxes anymore?
  • You may be at risk for foreclosure!
  • Is there anything you can do?
  • You may want to look to the terms of the will.
  • For example did it specifically award you any funds to maintain the home and live in it?
  • Maybe the sum you are getting just is not enough to keep the house and maintain it, are you prepared to ask for more?
  • Experienced West Palm Beach probate litigators know that a cheap inheritance may be fixed in probate court but what has to be shown?
  • Want to learn more about the issue?
  • Check out what is going on with Robin William’s estate as his former wife asks that she get more money to maintain her waterfront home in California.

William’s Estate is in Court…Again

  • Susan Schneider was married to Williams for three years before his unfortunate death a little over a year ago.
  • Now about a year later she has filed new documents in Tiburon County’s probate court.
  • She claims she can longer afford to live in the 9.1 million dollar waterfront estate left to her in William’s last will and testament.
  • Robin left instructions saying that his wife should be allowed to live in the house until her death and receive money to maintain it through her lifetime
  • According to court documents the money she has been given is simply not enough.
  • In fact she claims she has actually gotten no money because no one can agree on the amount she should be given.
