Although this is not a Florida probate opinion, Florida trust and estates lawyers encounter very similar trust disputes. Here, Frank Restaino brought a seven-count petition seeking to redress amendments to a trust agreement that his late step-mother made. These amendments removed Restaino and his children as beneficiaries. The original petition and an amended version were both dismissed by the trial court with prejudice. Frank Restaino appealed.
