Are you in the middle of an undue influence case, or an inheritance lawsuit, or probate litigation? If you are, you may need o hire Florida litigation counsel. Here’s five tips you should consider when hiring a trust and estates law firm:

  1. Think about experience. Most people would tell you that they want an experienced lawyer who has been trying probate cases for 20 years or more.
  2. Focus. Does your probate lawyer limit his or her practice to this one area of the law? Florida probate litigation, trust litigation, and guardianship litigation is very unique. There are specific rules that your lawyer should know very well, such as the probate rules, trust code, and specific relevant statutes.
  3. Furious. Is the trust and estates lawyer fast and furious, or focused and furious? Most clients want an aggressive attorney who will fight for them. When someone is involved in an inheritance lawsuit in Florida, they want a West Palm Beach lawyer who is passionate and moving forward with their case. They don’t want someone who is docile and reactive, rather than proactive.
  4. Consider real life experience. Does your probate attorney actually try cases, and hold evidentiary hearings, introduce evidence, and know how to cross examine witness? be careful because there are a lot of really good probate lawyers and estate planning lawyers who really don’t go to court but say they do litigation.
  5. Commitment. Is your Florida probate lawyer going to be with you until the very end? Do they know how to argue every action of each cause of the lawsuit? if there is an appeal, do they know how to handle it? It is important that the lawyer has experience in handling probate appeals.
