West Palm Beach Discovery

  • In general there are four big types of discovery you can expect to be encountering.
  • Depositions, Requests for Production, Requests for Admission and Interrogatories.
  • Do you know the differences?

Depositions

  • This is probably the most intimidating of all forms of West Palm Beach discovery. Ironically this can be ordered on a person who is not even party to the lawsuit.
  • Basically one party sits and is questioned by both parties’ attorneys.
  • This is done under oath outside of the courtroom but a reporter takes down word for word what you say.
  • Watch out because these admissions can be used against you in a West Palm Beach court room.
  • Litigators love to use these to impeach you while your on the stand.

Requests for Production

  • This is a simple document sent by the other side requesting a right to inspect or copy documents.
  • You can condition your cooperation on them paying the costs of copying but the costs need to be reasonable.
  • Just because you do not like a document or do not want to use it at trial does not mean it is exempt here so watch out!

Requests for Admission

  • These are statements that you are asked to either admit or deny on paper.
  • Think of this as a sort of paper deposition because your admissions are signed under oath.
  • This is a great way to get the other party to acknowledge the authenticity of documents for trial.

Interrogatories

  • These are questions that you can serve on the other party and make them answer under oath in writing.
  • Subject to the rules of evidence these can be used in a West Palm Beach trial court as well to make your point and prove your case!
