post about Four Things to Consider Before Making a Will Online

Are you using a legal form website to make your   Florida testamentary documents? Do you know what is necessary to make a valid Florida will? More importantly do you know what is going to happen if you fail to execute the will in conformity with Florida law? Have you heard of a will contest? What happens when part of the will is set aside? Experienced Palm Beach probate litigators know that you get what you pay for. Take a look at these four things to consider that a legal website is never going to be able to discuss with you.

  1. Legal Advice. In order to give legal advice in Florida you have to actually have a license to practice law. Did you know that these large Internet based form companiescouldn’t render legal advice? That is because those sites are not attorneys. More importantly they are not your attorneys. That means these forms come with no guarantee that they are the right form for you.
  2. Intestate Succession. If your will is invalid then your assets will be inherited throughintestate succession. Do you know the Florida rules of intestate succession? Did you know that a child you disinherited in your will could still end up collecting under these circumstances?
  3. Trusts. Trusts and other documents are becoming more and more popular to avoid probate. Unlike wills these documents are highly specialized and require expertise. I highly doubt you are going to find a legal form website that has a fill in the blankstestamentary trust and if you can do you trust it?
  4. Minor Mistakes. Minor mistakes are not so minor when they invalidate your entire will. Then what happens? Intestate succession! Do you know what makes a West Palm Beach will valid? Do you have two signatures? Is it notarized? These minor mistakes could lead to an invalid will.

Lastly one thing to keep in mind is that an experienced Palm Beach probate litigators know tricks to save time and money. Is that website advising you on how to minimize estate taxes? Has it mentioned a self proving affidavit to save your witnesses trouble?
