WEST PALM BEACH, FLORIDA — On April 27, 2016, guardianship litigation attorney John Pankauski spoke to approximately 80 employees of the V.A. in West Palm Beach

What is a Guardianship Lawsuit Like in Palm Beach?

  • Pankauski, who handles trials and appeals throughout Florida on wills, trusts, estates & guardianships, spoke about the Florida guardianship process.
  • Specifically, Pankauski relayed what it is like to practice law and handle trials for wards, family members and guardians in Palm Beach County.
  • There are three courthouses which hold guardianship lawsuits. One is on PGA Blvd. in Palm Beach Gardens and is called the North County Courthouse.  The Main Courthouse is downtown in West Palm Beach just steps from the Pankauski Law Firm, which is a Florida probate litigation law firm. Finally, there is the South County Courthouse in Delray Beach.
  • Each courthouse has probate court judges who handle trials and hearings on wills, trusts, estates, probates and of course Palm Beach guardianships.
  • You can read all about Florida guardianship law by looking online at Florida StatutesChapter 744 which is the Florida Guardianship Code.  Ask any Florida probate attorney and they will tell you that starting with the guardianship laws, and the probate rules, is a great way to learn about Palm Beach Gardens guardianships.
  • In Florida, the appeals courts, or appellate courts, like Palm Beach’s 4th District Court of Appeal, hear appeals for guardianships and trusts.
  • Pankauski spoke about how a guardianship is started in Florida and what family members can do if they want to be heard but they did not file for guardianship.
  • Pankauski also mentioned the importance of health care workers, nurses assistants, nurses aids and powers of attorney and trustees of a revocable living trust.
  • He noted that Florida has its unfair share of financial exploitation of the elderly andelder financial abuse of those who suffer from memory loss, dementia and Alzheimers.
  • You can read more about guardianships in 2017 when Pankauski is expected to release his third book on probate matters, this one will be about guardianship wars.  The book reviews and gives insight when families, 2nd spouses, adult children from a prior marriage or relationship, engage in litigation over a parent’s or spouse’s care in guardianship court.
