The legendary DJ, who reportedly suffers from dementia and is worth $80 Million, is evidently the subject of a dispute as to who will control his “person” and “property.”

As South Florida residents know, dementia affects a number of senior citizens from Ft. Lauderdale to Jupiter.

If untreated, or not treated properly, dementia can worsen and pose a danger to seniors.

Sadly, seniors who suffer from dementia are more susceptible to financial exploitation.   Florida has more than its fair share of mis-use of power of attorney documents and mis-use of bank accounts.

When someone becomes unable to handle their affairs, a guardianship proceeding may need to be filed.   In Palm Beach, there are three Probate Courts which handle guardianships. The Probate Judge will decide whether a person is incapacitated or not, and if so, whether a guardianship is needed. A guardianship may not be needed if a revocable trust or power of attorney are in place.
