Safina v. Sorensen

  • This was a very interesting probate appeal from California.

  • Florida does not still use common law marriages like it used to.
  • Florida estate attorneys sometimes end up in some very interesting cases because a long time girlfriend or boyfriend may in all equity deserve the rights of a spouse.
  • This case dealt with that issue.
  • The main problem was the tombstone.
  • How is a tombstone the subject of a probate lawsuit?
  • Basically the girlfriend of 48 years wanted the tombstone to say one thing and the decedent’s brother had a different opinion.
  • This issue made it all the way up to the appeals Court in California.
  • In the end the brother was the one who got to decide what was on the tombstone.
