On March 1st, 2017, Pankauski Hauser partner John Pankauski completed a trial on the issue of reasonable compensation for a personal representative’s attorney whose work ended prior to complete estate administration. The trial took place in the Delray Beach Probate Court, before the Honorable Howard Coates.

The Florida Probate Code statutes on attorneys fees in an estate proceeding which the probate trial dealt with were 733.6171 http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0700-0799/0733/Sections/0733.6171.html   and 733.6175 http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=0700-0799/0733/Sections/0733.6175.html.   The issue before the court was what constitutes “reasonable compensation” for an attorney who provided work to both the personal representative of a Florida estate, and also to the trustee of a decedent’s revocable trust.  If you have an attorneys fee dispute in a Florida probate, estate or trust matter, give John a call at 561-514-0900 Extension 101 or email him at john@phFlorida.com .
