PALM BEACH TRUST BENEFICIARIES: not sure which way to go?

post about PALM BEACH TRUST BENEFICIARIES: not sure which way to go?

Now hold on, trust beneficiaries.

Before you start hiring trust litigators and spending money ready to sue your Florida trustee or the investment manager, consider this:

  • What may outrage YOU, as a trust beneficiary, is not outrageous at all in the world of Palm Beach trusts.
  • Many times, trust beneficiaries looking for trust trial lawyers are all gung-ho to sue their trustee…….
  • Only to find out that the Palm Beach trust isn’t being run that badly as you thought.

2014-06-06 Street Sign Not Sure where to goSo, here’s some advice to you trust beneficiaries who may not understand how Palm Beach trusts are administered :

  • Spend a few $ and hire an experienced trust lawyer familiar with Florida Trust Law: like someone with 20 years ‘ experience.
  • Get an objective, plain English answer to your questions.
  • Explain why you are mad at the trustee -focus!
  • Feel free to get a second opinion…. We do that with doctors, why not Palm Beach trust lawyers, right?

My point is this: the outrage which some beneficiaries of estates or trusts demonstrate can be mis-placed….. or how Palm Beach trusts & estates are run can be mis-understood. Not sure which direction to go in? Look both ways and check your map. Check the signpost. Oh yes, and talk with someone who understands the Florida Trust Code.

Why do I say that? Because lawyers at our West Palm Beach trust law firm are often called upon to replace another trust lawyer representing a beneficiary or a trustee and the prior trust lawyer is doing a fine job…. And when I tell the prospective client that….they get mad or disappointed. Same thing with beneficiaries….. I’d love to represent you, but it doesn’t make sense if your trustee is doing a good job. So , before you run down to the Probate Court in Palm Beach and file a lawsuit: reflect & analyze.
