post about Palm Beach Guardianship: Getting Hearing Time

Involved in a Palm Beach guardianship matter?   Maybe mom or dad requires some assistance and there is a Palm Beach guardian.  If you want to take a stand or be heard, you may want to read a January 15, 2014 opinion from West Palm Beach’s 4th District Court of Appeal.  That’s the Palm Beach appeals court in Florida which hears guardianship & probate appeals for Palm Beach, Ft. Lauderdale and Stuart, Florida.

Palm Beach Guardianship Courts: Give You An Opportunity to Be Heard

  • In Palm Beach guardian cases, a person who has an “interest” in the person may have an opportunity to participate in the Palm Beach guardianship.
  • If you are an “interested person” such as a family member, advisor, service provider, neighbor, you may be able to take a position and have your thoughts be heard before the Palm Beach Probate Judge.
  • In Palm Beach, all guardianship cases are held in the probate division.
  • Probate judges in Palm Beach also determine whether someone is incapacitated or not and then they can remove certain rights, leave those rights with the person, or even restore them later.

In this recent Palm Beach guardianship appeals case, the gist of the appellate court opinion is that everyone should be given an opportunity to be heard: to make your case in a Palm Beach probate court.  Sounds simple?  Maybe, but it’s important stuff.
