post about How Do I Get Information About a Florida Probate and my Inheritance?

Want more information about your mom or dad’s Florida probate proceeding? Has a probate even been opened for your mom or dad’s estate? What about your inheritance? How can you find out about your inheritance? How do you determine if you even inherit from a decedent? Here are 5 things to consider:

  1. Has a will been filed? In Florida, wills are filed with the clerk’s office where the decedent was domiciled at time of their passing. Therefore, if your dad died in Palm Beach, Florida, his will should be filed with the Palm Beach County clerk’s office.
  2. Is there a probate open for the person who passed away? Go online to the county clerk’s website and find out if a probate proceeding has been opened. You can search for case information with the decedent’s name.
  3. If a probate has been opened, you can find out who the executor or personal representative is. The personal representative(PR) will run the estate.
  4. Get involved!  Contact the PR or their attorney. If you don’t have an attorney, send a letter to them or file some type of appearance in the probate proceeding so that you can get copies of documents. Remember, Florida probate law helps those who exercise their rights. Being silence is not always good. In fact, probate litigation attorneys know that silence may sometimes imply consent or approval. Florida probate law helps people who exercise their rights.
  5. If there is no PR appointed, and you’re a beneficiary or heir of someone who died without a will, open up a Florida probate yourself.
