Undue influence in Florida Wills, what the heck does that mean? Undue influence is a means to set aside a Will, a means to have a probate court in Florida declare the Will to be void.
What is undue influence? Undue influence is when somebody improperly pressures, or forces, or coerces somebody to put them in a Will or to sign a Will. That’s not proper, and upon a proper estate lawsuit, a Will challenge, that Will can be set aside. But be careful. These contests can be very expensive and you need to be mindful of a doctrine, a legal doctrine in Florida that may revive prior Wills that are still out there.
