The Surviving Spouses or Widows of the Florida Elective Share

If you’re a surviving spouse or a Florida widow, you have an elective share. That is a guaranteed inheritance to at least 30% of the estate. Now, what assets go into that estate, and how you calculate that 30%, is the subject of a different discussion. But the takeaway here is if you’re a spouse, you have a guaranteed inheritance. I don’t care what the will says. You can’t be disinherited unless you signed a prenup.
