Modifying Trusts
Can you modify or change a Florida trust? Yes you can. The Florida trust code has a specific provision that permits you to do it. What does that mean to modify a trust? Can you change how the money is distributed? Yes. Can you change who might be the trustee? Yes. Can you change when the money is distributed? Yes. You can modify a Florida trust if it’s in the best interests of the beneficiaries, or are there are circumstances that weren’t anticipated by the person who created the trust. Very limited exceptions, very narrow set of law that will permit you to change the trust or modify it. But your trust litigator will know all about that.
