Guaranteed Inheritances for Surviving Spouses and Florida Widows

Surviving spouses, widows in Florida, you are entitled to a guaranteed inheritance. It’s called an “elective share.” It may also be called a “pretermitted air share,” or “pretermitted spouse share.” What does that mean? That means that no matter what the will says, or if there is no will, you have a guaranteed inheritance of 30 to 50%. If there’s a will that left everything to a prior spouse, don’t worry about it. If there’s no will, don’t worry about it. If there’s a will that leaves everything to the kids and not to you, don’t worry about it, unless you signed a prenup.
