How do you get a copy of the Florida will? It may be as simple as going to the Clerk’s Office. Why? Because the person that had the original last will of the person that just died, they are required by law to file it within 10 days of death with the County Clerk. The county where the person passed away lived. So you can go right down there and get a copy of the will. It’s a public document. What do you do if there’s a will that’s out there and somebody doesn’t file it? Well, there’s a new law in Florida that lets you file a petition and get your attorney’s fees under certain circumstances.
