The Florida Probate Process
What is the Florida probate process? Well, we think of it, typically, as a court process in the probate division of our courts that involves the administration of an estate. So, say when somebody passes away, you’re required to file the Will. Whoever has the original Will must file it with the clerk for the county where the person passed away. And you typically file a petition for administration, something that tells the world, “Hey, I’m administering this person’s estate. If you think you’re a beneficiary, if you think this person owed you money, come forward because I’m going to gather the assets, I’m going to give notice to everybody, and then I’m going to distribute the estate.”
