How do you get money back from an estate lawyer who is charging too much for the Florida Probate. Hello, my name is John Pankauski, I’m a litigation attorney at Pankauski Hauser in West Palm Beach, Florida. The appellate lawyers and litigation attorneys here handle matters throughout the state of Florida and one of the most common problems that we here about is from family members and beneficiaries, often from outside of the state of Florida, who are upset at probate lawyers and estate attorneys. They complain that these estate lawyers are taking too much in fees from a Florida probate or an estate and sometimes from a trust. So do you know what to do if the estate attorney is charging too much in fees? Well you actually have to file a petition to review that compensation and you are going to have a mini trial on that with evidence and witnesses and documents and time sheets of the lawyer who you think is charging the estate too much. Read Florida Probate Code, section 733.6175. That’s a very specific Florida law, Florida Probate law that has to do with filing a petition to challenge the attorney fees of that estate lawyer who is charging to much. But remember, that is full blown litigation so you need to be prepared for a fee fight and know the special rules that apply in Florida probate.
