If there’s a Florida probate going on, if there’s an estate proceeding that is happening and if you have rights that you need to exercise with the person who passed away, you may need to exercise those rights with the estate. One of the common examples is a prenuptial agreement or a contract that you had with somebody who now passes away. Well, if you had a rights or obligations or the person who passed away did, you’re a creditor, you need to file a statement of claim in the estate and attach a copy of that contract or that prenuptial agreement. If the person who passed away owed you money, you’re also a creditor. File a statement of claim, protect your rights. Florida has very short statute of limitations for creditors so be careful.
