Can a Florida probate court judge command you not to talk about your estate case? My name is John Pankauski, I’m a probate litigation attorney with Pankauski Hauser in West Palm Beach. We have a Statewide practice even though we’re based here in West Palm Beach.
There was a recent 2018 Florida appellate opinion that talked about a gag order in a probate case where somebody was prohibited from talking about or disseminating information about the probate matter. Is that proper and under what circumstances can you get that gag order rescinded, vacated or revoked.

Worried about is Swanick, is she’s a personal representative of an estate versus Lorish. The WestLaw citation is 2018 WL 237-0467. It is a brief opinion but it also mentions the Fox case which is very important for trying to get a proper order if you don’t want anybody to talk about your probate case.
