December 2014 Case out of Third DCA highlights the importance of understanding the difference between different types of orders and how to appeal them:
- The Third District Court of Appeal operates out of Miami Florida and oversees appeals cases for all of Miami Dade. They recently published there opinion in December of 2014, in the case of Bloomgarden v. Mandel Case No. 3D14-556.
- The Plaintiff was suing an attorney over legal malpractice but the case became confusing when various material documents were very private do to a capital murder case that the attorneys had been helping the plaintiff with.
- An issue was brought on appeal and the plaintiff / Appellant offered three different arguments as to why the appellate court had jurisdiction, all three of which were denied.
