In a sad and tragic probate case, a probate beneficiary under a will and the late victim’s, or decedent’s, husband,split the $1 Million estate. Police are treating the death of the 41 year old woman, now, as ahomocide, with no “slayer statute” issues . Media outlets report the police are focussing on one person as a suspect, other than the boyfriend or the husband. The boyfriend of the victim was the named beneficiary under the victim’s will — not the woman’s husband.
- The woman was found dead outside of Charlotte, NC and had a will leaving her probate estate to her boyfriend, not her husband
- The named beneficiary –the boyfriend — and her husband evidently are sharing in theinheritance of her estate, which is estimated to be $1 Million.

- Probate lawyers and estate lawyers may wonder why the estate settlement came about, but perhaps because –not sure — that in most states, widows, or surviving husbands have almost guaranted inheritance rights including the so called Elective Share which can be a fixed percentage of the estate.
- Reports state that the probate beneficiary boyfriend and the husband agreed to a consent order where the husband would get a share of the estate. It’s not known how much the widower is inheriting from the estate.
- In some states, you cannot intentionally and completely dis-inherit your husband or wife by signing a will which leaves everything to a boyfriend or girlfriend
- Why are the police treating this death as a homocide? Not sure, but whenever a young person dies at the hands of a gunshot wound, it seems to beg the question of who did it, why and did anyone benefit. Evidently a person was in her townhouse the night she died.
